(CR.NO. 821 OF 2016) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition that petitioners shall appear before the XVII Metropolitan Magistrate, Saidapet, Chennai on the 1st working day of every month at 10.30 a.m. as per the order dated 10/10/2018 passed in Crl.M.P.No.12128 of 2018 in the Crl.A.No. 554 of 2018.(IN CRL.MP.NO.9877 of 2021) Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.A.B.FATHIMA SULTHANA, Advocate for the Petitioner and of MR.R.MUNIYAPPARAJ, Additional Public Prosecutor on behalf of the Respondents the court made the following order:- (Order of the Court was made by P.N.PRAKASH,J.) This criminal miscellaneous petition has been filed seeking to relax one of the conditions passed by this Court vide order dated 10.10.2018 in Crl.M.P.No.12128 of 2018 in Crl.A.No.554 of 2018.

This Court granted suspension of sentence and bail to the petitioners on 10.10.2018 in Crl.M.P.No.12128 of 2018 in Crl.A.No.554 of 2018, on various conditions, one of which is that the petitioners should appear before the XVII Metropolitan Magistrate Court, Saidapet, Chennai, on the first working day of every month at 10.30 a.m., for relaxing which, the petitioners have preferred the present criminal miscellaneous petition.

In the opinion of this Court, the aforesaid condition cannot be relaxed as the whereabouts of the petitioners should be known to this Court till the disposal of the main appeal. Hence, this criminal miscellaneous petition is closed. The Registry is directed to call for the records, prepare the typed set of papers and post the main appeal for final hearing in the last week of October, 2021.
