This application has been filed seeking leave of this Court to institute the suit against the Receiver appointed by this Court in respect of the suit property by an order dated 07.07.2011.

2.The suit has been inter alia filed to recover the arrears of rent to the tune of Rs.7 crores.

3.The first plaintiff being a Receiver filed this application seeking leave of this Court to institute the suit.

4.On persual of the order of this Court dated 07.09.2011, the first plaintiff has appointed as Receiver. The Receiver is empowered to collect not only the rental income from the tenants, but also collection of the rental agreements. As the Receiver has empowered to collect including recovery of arrears of rent, such leave is granted.
