(Order of the court was made by the Hon'ble Acting Chief Justice) Heard Mr.C.Prakasam, learned counsel for the petitioner; Mr.A.Edwin Prabakar, learned State Government Pleader for respondent No.1; and Mr.M.Habeeb Rahman, learned Government Advocate for respondent No.2.

2. Apprehending that the second respondent would seal the marriage hall in question, the petitioner has filed this miscellaneous petition to extend the time limit granted by this Court in W.P.No.32781 of 2017, dated 11.9.2023, by a further period of four months.

3. On a perusal of the order dated 11.9.2023 passed in the writ petition, it is evident that this Court directed the petitioner to submit a reply along with documents to support its claim that the construction is authorised and directed the planning authority to consider the reply

and the documents filed by the petitioner and take a decision with regard to the construction being authorised or otherwise within one month from the date the documents are placed on record by the petitioner. The petitioner defaulted in submitting the documents within the period stipulated in the order dated 11.9.2023.

4. The order dated 11.9.2023 is a self-contained order, with a default clause. As the petitioner failed to submit the documents within the time stipulated, the order dated 11.9.2023 shall automatically become effective. Any action taken by the authorities pursuant to the order of this Court dated 11.9.2023 cannot be stalled. Thus, the prayer of the petitioner to extend the time limit for a further period of four months cannot be acceded to.

5. Accordingly, W.M.P.No.17305 of 2024 is dismissed. (R.M.D., A.C.J.) (M.S.Q., J.) 24.06.2024 bbr
