PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to consider the representation dated 21.9.2015 made to the first respondent for payment of compensation as the type of loss to the petitioner is one of residential and type of tenure is one of squatter and the type of structure is one of permanent.

Mr.R.Vijayakumar, learned Additional Government Pleader takes notice for the respondents. Heard the learned counsel for the petitioner. By consent, the writ petition itself is taken up for final disposal.
2. The petitioner would admit that the second respondent has remitted a sum of Rs.12,180/- into the bank account of the petitioner on 2.6.2015. However, it is not clear as to whether https://hcservices.ecourts.gov.in/hcservices/
the petitioner wants additional compensation over and above the said compensation amount or that he wants re-determination of the same. The learned counsel for the petitioner has drawn the attention of this Court to an award passed by the second respondent, which being a rehabilitation and re-settlement award dated 14.5.2015 and claimed that the same was in respect of the petitioner's neighbouring plot owner. Since the petitioner is not clear on facts, he has to pursue the representation before the second respondent. The petitioner has already approached the second respondent by way of a representation dated 21.9.2015.
3. Accordingly, without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to the second respondent to consider the representation of the petitioner dated 21.9.2015 on merits and pass appropriate orders thereon in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs.
