Respondents PRAYER : Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records of the 2nd respondent pertaining to the Selection List declared on 15.07.2008 and quash the same in so far as the post of Assistant in the Office of the Commissioner of Commercial Taxes General Turn - destitute widow quota included in Combined Subordinate Services Examination-I, 2007 in concerned and consequently direct the respondents to appoint the petitioner as Assistant in the Office of the Commissioner of Commercial Taxes General Turn- destitute widow quota pursuant to the selection held pursuant to notification dated 25.06.2007.

O R D E R

The prayer in the writ petition is to call for the records of the 2nd respondent pertaining to the Selection List declared on 15.07.2008 and quash the same in so far as the post of Assistant in the Office of the Commissioner of Commercial Taxes General Turn - destitute widow quota included in Combined Subordinate Services Examination-I, 2007 is concerned and consequently direct the respondents to appoint the petitioner as Assistant in the Office of the Commissioner of Commercial Taxes General Turn- destitute widow quota pursuant to the selection held pursuant to notification dated 25.06.2007.

2. Today, when the matter is taken up for consideration, the learned Counsel for the petitioner filed an affidavit before this Court stating that the petitioner has joined the service as Revenue Assistant in Kancheepuram District as early in the year 2008 and now working as Deputy Tahsildar, Chennai Airport Extension Scheme and therefore seeks permission of this Court to withdraw the preset writ petition.

3. This Court, earlier by an interim direction dated 24.09.2008 directed the respondents to keep vacant one post of Assistant in the Office of the Commissioner of Commercial Taxes, General Turn- Destitute widow quota, until further orders. Since the learned counsel for the petitioner filed an affidavit seeking permission of this Court to withdraw this writ petition as it became infructuous, the respondents are hereby informed that the said post need not be kept vacant and necessary orders may be issued in this regard.

4. In view of the Affidavit dated 31.07.2018 filed by the learned counsel for the petitioner and also recording the submissions made by the learned counsel for the petitioner, the present writ petition is dismissed as having become infructuous.

No Costs.

Consequently, the connected Miscellaneous Petitions is closed.
