This application has been filed seeking leave to sue the respondent/defendant, whose office is situated at New Delhi, outside the jurisdiction of this Court.

2. The plaintiff participated in the tender and the security deposit given by the plaintiff was forfeited by the respondent/defendant. According to the plaintiff, the said forfeiture is bad. In such circumstances, they have filed this suit seeking for recovery of forfeited amount together with interest and costs.

3. The tender was floated in Chennai in respect of a property situated at Chennai. Since major part of cause of action has arisen within the jurisdiction of this Court, this application has been filed seeking leave to sue the respondent/defendant, who is having its office outside the jurisdiction of this Court.

4. After giving due consideration to the fact that major part of cause of action has arisen at Chennai, this Court is inclined to grant leave to sue as prayed for and accordingly, this application is allowed. Registry is directed to number the suit if it is otherwise in order. 14.12.2023 rkm 2/3
