This Petition has been filed under Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the debts of Sundharamoorthy, the brother of the petitioners, who died on 23.12.2019. The securities left behind have been stated in the schedule to the petition which was a savings bank account in Indian Overseas Bank, Vellore.
2. After publication was effected, the petitioners were called upon to tender evidence. The third petitioner examined herself as PW-1.
They were two other sisters V.G.Sagunthala and V.G.Hamsavalli, who had pre-deceased and their death certificates were marked as Exs. P-1 and P-4. The death certificate of the husband of V.J.Hamsavalli was marked as Ex.P-3.
3. It was stated in the petition that V.G.Sagunthala had obtained divorce with her husband on 09.01.2004 in F.C.O.P.No. 39 of 2004. It was stated that the petitioners are the only legal heirs and their mother had died and her death certificate was produced as Ex.P-2. The legal heirship certificate of the mother was marked as Ex.P-5 and the death certificate of Sundharamoorthy was marked as Ex.P-6. The copy of the passbook was marked as Ex.P-7. C.V.KARTHIKEYAN, J.

4. In view of the evidence produced, this Petition stands allowed as prayed for and a direction for grant of Succession Certificate to the petitioners with power to collect the debts and to receive the interest specified in the schedule is issued.
