The suit has been filed on account of forfeiture of security deposit by the defendant. The plaintiff participated in a bid conducted by the respondent. But the said contract was not awarded to the plaintiff. But at the same time, the plaintiff claim that illegally the security deposit given by the plaintiff has been forfeited by the defendant. The plaintiff is having its office at Chennai. The auction took place only at Chennai. The security deposit alleged to have been paid by the plaintiff is also claimed that to be made only at Chennai. Since part of cause of action arose within the jurisdiction of this Court for the suit claim, this Court is allowing this leave to sue application as prayed for.

However, liberty is granted to the defendant once they enter appearance to file an application for revocation of leave, in case the defendant is able to make out a case that the suit has not been properly instituted by the plaintiff before this Court. 2.Accordingly, this application is allowed as prayed for. 3.Registry is directed to number the suit, if it is otherwise in order. 13.11.2024 ssr https://www.mhc.tn.gov.
