Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the 3rd and / or 4th respondents to defreeze the petitioner's Bank Account No.332501110050000 and permit the petitioner to operate the said account pending disposal of the above Writ Petition.

ORDER

This Writ Petition is filed for a direction directing the third respondent to de-freeze the petitioner's account and permit him to operate the same.

2. The petitioner is the owner-cum-developer of the property known as Vandalur Park Residency. The petitioner is also holding the account with the fourth respondent. While being so, on the instructions given by the first respondent, the fourth respondent has frozen the account 2/6

of the petitioner and did not permit the petitioner to operate his account on the ground that the accused in Crime No.7 of 2022 on the file of the first respondent, had transferred the sum of Rs.3,3,09,000/-. It was transferred from the crime proceeds. Though now investigation is completed in Crime No.7 of 2022 and filed the Final Report and the same has been taken cognizance in C.C.No.9 of 2023 on the file of the Special Court for TNPID Act cases, Chennai, on permission, now, the further investigation is ordered and the same is not in progress.

3. While pending the further investigation, the request made by the petitioner to de-freeze the account cannot be considered and also the substantial part of the crime proceeds has been transferred to the petitioner's account by the ninth accused. Though the petitioner is not arrayed as an accused so far, the further investigation is ordered and is pending. That apart, already, the petitioner filed a Writ Petition before the Hon'ble First Bench of this Court in W.P.Crl.No.649 of 2026 and the same has been dismissed as withdrawn with a liberty to work out the remedy in accordance with law. However, once again, the petitioner filed the Writ Petition before this Court for the very same prayer. In view thereof, the prayer sought for in this Writ Petition cannot be considered. 3/6

4. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
