The intervening Petition in Crl.M.P.No. 13444 of 2023 is allowed.

2. The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 498(A), 509 of IPC read with Section 67 (A) of Information Technology (Amendment) Act 2008, read with Section 4 of Women Harassment Act, 2002 in Crime No.27 of 2022, with respect to the incident which had taken place on 23.09.2022, seeks anticipatory bail.

3. It is stated on behalf of the respondent that the investigation has been completed and the final report had also been filed and taken cognizance as C.C.No. 33 of 2023 before the Additional Mahila Court.

4. The petitioner should appear before the said Court on receiving summons.

5. It is stated on behalf of the defacto complainant that the settlement talks are going on.

6. The learned Magistrate may also keep that factor in the mind and the petitioner should answer before the Court. This Criminal Original Petition does not lie and accordingly, it is dismissed. It is clear that the word 'dismissed' is used since summons had been issued by the Magistrate Court and it is for that Court, where cognizance had been taken and the final report had been filed, to pass appropriate orders.
