ORDER

This petition has been filed by the appellant to amend the substantial questions of law which some corrections.

2. The reasons stated by the appellants is justifiable and the proposed amendment does not change the nature of relief claimed in the main suit. Therefore, this petition is allowed. The following substantial questions of law as per amended petition is framed in the main second appeal: "a. Whether the lower appellate court is right in reversing the well considered judgment of the trial court, when the balance of convenience is lies with the Appellant / Respondent / Plaintiff herein ? b. Whether the lower appellant court is right in reversing the well considered judgment of trial court, when the Respondent / Appellant / Defendant had not performed his part of contract to execute the sale deed and attempts to sell to third parties ?

c. Whether the lower appellate court is right in negative the findings of the trial court where the Appellant / Respondent / Plaintiff hold registered sale agreement in his favour and Respondent / Appellant / Defendant attempted to breach the agreement ?"

3. Registry is directed to amend the substantial questions of law. The liberty is granted to the respondents to put forth arguments to the amended substantial questions of law at the time of arguments in the main appeal. 2/4
