O R D E R

(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent Police for the offence punishable under Section 6(4) of Tamil Nadu Scheduled Commodities (RDCS) order 1982 r/w. 7(i)(a)(ii) of Essential Commodities Act, 1955 in Crime No.372 of 2019, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant is that the petitioner along with other accused illegally transported 15,000 Kgs of PDS rice without proper license. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that he has not committed any offence as alleged by the prosecution. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner along with other accused were illegally transporting 15,000 Kgs of PDS rice without obtaining proper license. He would further submit that the petitioner has two previous cases, which are similar in nature. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that there are two previous cases as against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
