PRAYER: This Criminal Original Petition filed under Section 438 of Cr.P.C., seeking to enlarge the petitioner on bail, in the event of his arrest by the respondent police concerned in Crime No.1123 of 2020, pending on the file of the respondent police. ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379, 430 of IPC and Section 21(1) of the Tamil Nadu Mines and Minerals Act in Crime No.1123 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 13.10.2020, the petitioner being the owner of the Scorpio car has transported 50 bags of sand illegally and the same was intercepted by the respondent police. Hence the complaint.

3. The learned counsel for the petitioner would submit that it is impossible to transport 50 bags of sand in a Scorpio car and therefore the case is a foisted one with imaginary particulars.

4. Heard the learned Additional Public Prosecutor appearing for the respondent.

5. On a perusal of First Information Report, it reveals that the sand has been transported illegally in the Scorpio car. Following the view expressed by this Court in the case of Bala @ Balasubramani versus Inspector of Police, Thakkolam Police Station, Vellore District reported in 2020 2 Law Weekly Crl 528 and also considering the anticipatory bail petition, exploitation of the natural resources, rootlessly has been left uncontrolled, due to connivance of persons at high places, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition stands dismissed.
