O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c) r/w 20(b)(ii)(B), 8(b) r/w 20(a)(i) and 29 (1) of NDPS Act, 1985 in Crime No. 770 of 2020 on the file of the respondent police, seek anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate.

3.The case of the prosecution is that, on 12.10.2020 they apprehended two persons on mere intimation about cultivation of Ganja plant. 1 1⁄4 kg of ganja and cash of Rs.2,56,150/- were seized from them. From the confession statement of these accused, they have come to know that the petitioner herein is the person who supplied seeds of ganja plant. 4.According to the petitioner, she is an innocent person and she has nothing to do with the crime, being 65 years old lady, carrying on her livelihood as an agricultural coolie. Due to false implication by A1 and A2, she apprehends arrest. 5.The learned Government Advocate would submit that the petitioner herein is a professional drug peddler and supplier of ganja seeds to others. The petitioner has a bad antecedent history sheet and there are seven cases of similar nature under NDPS Act, out of which, four are still pending.

6.Taking note of the gravity of the offence and the alleged overt act of the petitioner herein, this Court is not inclined to grant Anticipatory Bail.
