Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Certiorari calling for the records in Industrial Dispute No.151/2001 dated 27.4.2007 on the file of the 1st respondent and quash the same as arbitrary, illegal and without jurisdiction.

O R D E R

The above Writ Petition has been filed by the Management challenging the award passed by the 1st respondent Labour Court. As per the award, the petitioner was directed to reinstate the 2nd respondent in service with full backwages, continuity of service and all other attendant benefits.

2. The 2nd respondent had superannuated in May 2018. On the last occasion, the learned counsel for the petitioner had given a cheque for a sum of Rs.12,790/- to the 2nd respondent's counsel. The learned counsel for the petitioner had submitted that earlier under two cheques of a sum of Rs.10,000/- and Rs.63,610/- had been paid to the 2nd respondent and the learned counsel for the 2nd respondent had sought time to verify the same. This Court had also directed the petitioner to produce the Bank Statement showing the said payments. 2/4

Today, when the matter was called, the learned counsel for the petitioner has produced the Bank Statement which clearly shows that on 09.06.2014 a sum of Rs.10,000/- and on 13.06.2014 a further sum of Rs.63,610/- was transferred to the 2nd respondent's account. In addition to that on the last occasion i.e. on 22.07.2024, a cheque for a sum of Rs.12,790/- has also been given to the 2nd respondent's counsel. Therefore, the entire amount due under the award has been paid.

4. Therefore, since the petitioner has complied with the award passed by the Tribunal, no further orders are required to be passed and the Writ Petition is disposed of accordingly.
