O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379, 430 of IPC read with Section 21 (1) Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.1759 of 2020 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner herein has illegally transported one unit of Savudu sand in Lorry bearing registration No.TN-19-P-6577 without valid license. 3.The learned Government Advocate opposed the grant of Anticipatory Bail on the ground that this petitioner is an habitual offender of illegal mining and he has not complied with the condition when Anticipatory Bail was granted earlier in Crl.O.P.No.8778 of 2020.

4.The petitioner has now come out with the scope of seeking Anticipatory Bail.

5.Now on considering the gravity of the crime and the dictum laid down by this Court rendered in the case of "Bala @ Balasubramani -vs- State represented by the Inspector of Police, Thakkolam Police Station, Vellore District" dated 03.09.2020 in Crl.O.P.No.13334 of 2020 etc. batch, this petition for Anticipatory Bail is dismissed. -sd/- 22/10/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
