Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus to direct all the respondents to consider the petitioner's representation dated 09.03.2024 according to RTI report given from the 4th respondent in Na.Ka.No.A/269/2018 said that the Survey No.21/3b2c did not came into the Tamil Nadu Urban Land (Ceiling 1/4

and Regulation) Act 1978, so re-upload through online for the patta No.206 of Survey No.21/3b2c.

By consent of both sides, this Writ Petition is disposed of at the stage of admission itself.

2. It is the case of the petitioner that the petitioner had already filed a writ petition in WP.No.3734 of 2023, wherein this Court had directed the authorities concerned to consider the representation of the petitioner on merits and pass necessary orders. According to the petitioner as per RTI reply, Survey numbers were wrongly notified in the Tamil Nadu Urban land (Ceiling and Regulation) Act. Therefore, according to him the petitioner is entitled for patta.

3. The learned Special Government Pleader appearing for the respondents would submit that the third respondent had passed an order on 05.07.2024 rejecting the claim of the petitioner and also produced the copy of the said communication before this Court. The representation of the 2/4

petitioner was rejected on the ground that the petitioner's land was already been notified under fixation of ceiling of land and in this regard, GO was also issued in GO.Ms.No.115, Revenue dated 23.01.1980.

4. Under these circumstances, unless the proceedings are challenged, this Court cannot direct the respondents to grant patta in favour of the petitioner. The petitioner is at liberty to challenge the proceedings in the manner known to law.

5. With the above observation, this writ petition is disposed of. No costs.
