The petitioner seeks direction upon the third respondent to register a case against the fourth respondent based on his complaint, dated 13.03.2015.

It is submitted by learned Additional Public Prosecutor, representing the respondent/Police that, on the complaint lodged by the petitioner against her husband, petition enquiry was conducted and the matter was referred to Social Welfare Officer for counselling, and the proposed accused is not appearing for counselling.

In view of the above submission, the Criminal Original Petition is closed with a direction to the third respondent to obtain report from the Social Welfare Officer, and thereafter, take https://hcservices.ecourts.gov.in/hcservices/

action in accordance with law by registering a case, if cognizable offence is made out, by following the dictum laid down by the Hon'ble Apex Court in re Lalita Kumari vs. Govt. of U.P. & others reported in [2013 (4) Crimes 243 (SC)].
