The petitioner/appellant/third defendant was represented by his Power of Attorney Agent one Mr.K.R.S.Ponnusamy Pandian before the trial Court, however, his whereabouts are not known for the past two years. Hence, the appeal suit has been filed by the third defendant himself with the present petition seeking to accept the cause title.

2.Considering the reasons assigned, this petition is ordered.
