Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed that the petitioner shall not be permitted to meet his children during the pendency of the Criminal Proceedings in Crl.O.P.No.2563/2019 vide order dated.19.02.2019 and permit the petitioner to meet his children once in a week.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.V.V.GIRIDHAR, Advocate for the petitioner and of MR.M.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:

This petition has been filed to modify the condition imposed on the petitioner in Crl.O.P.No.2563 of 2019 on 19.02.2019.

2. This Court while granting bail to the petitioner had imposed a condition that the petitioner will not be permitted to meet his children during the pendency of the Criminal Original Petition.

3. The learned counsel for the petitioner submitted that the children are now in the Government home and for the last 1 1/2 years, no one has met the children. The learned counsel for the petitioner submitted that the father may be given some visitation rights to the children so that relationship between the parties does not get affected permanently.

4. Heard, the learned public prosecutor appearing on behalf of the respondent police.

5. Taking into consideration, the facts and circumstances of the case, the petitioner is permitted to meet the children, who are now at the Government Home at Purasavakkam, during every second and fourth Sunday of every Month between 10.00 a.m., and 02.00 p.m., until further orders.
