C.M.P.No.12382 of 2022 in S.A.No.1488 of 2011 KRISHNAN RAMASAMY, J., This petition has been filed by the petitioner / appellant to condone the delay of 2719 days in filing the petition to set aside the abatement caused due to the death of the appellant in S.A.No.1488 of 2011. 2.Though the learned counsel appearing for the respondent wants to file formal counter, considering the reasons stated in the affidavit filed in support of this petition, and in the interest of justice and to give fair adjudication, this Court is inclined to allow the present petition. 4.Accordingly, this petition is allowed.
