ORDER

Seeking a direction to the second respondent herein viz., the Sub-Inspector of Police, Thammampatti, Salem District, to register the case on the basis of the complaint lodged by the petitioner on 30.03.2015, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 3.It is seen from the records that a suit is pending between the parties in O.S.No.53 of 2013 for specific performance of contract. In the present complaint, it is alleged by the petitioner that he was threatened and assaulted by the proposed accused on 29.03.2015 to withdraw the suit. But, the complaint was sent by post only on 30.03.2015 by the petitioner. Further, no medical report has also been enclosed along with the complaint. Therefore, this is not a fit case to issue a direction as prayed for by the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4.In the result, the Criminal Original Petition is dismissed and liberty is given to the petitioner to prefer fresh complaint with adequate details if there is a further threat from the proposed accused.
