(The case has been heard through video conference) This Criminal Original Petition has been filed seeking to enlarge the petitioner on bail in the event of his arrest in Crime No.947 of 2020 on the file of the Inspector of Police, Voimedu Police Station, Voimedu, Nagapattinam District.

2. The petitioner is the driver of the tipper tractor bearing Registration No.TN-51-AL-9115. The case has been registered against the petitioner and two others for the offence under Sections 379, 353 of IPC r/w 21(1) of the Mines and Minerals (Development and Regulation) Act-1957, for transporting half unit of sand illegally.

3. Following the dictum of this Court in Bala @ Balasubramani Vs. Inspector of Police, reported in 2020(2) Law weekly Criminal 528, this Criminal Original Petition is dismissed.
