O R D E R

This Criminal Original Petition has been filed to call for the records made in impugned charge sheet in C.C.No.87 of 2016 dated 10.8.2016 on the file of the Judicial Magistrate, Arakkonam and to quash the same.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondentPolice and perused the materials available on record.

3. Since no adverse order is being passed against the private respondent, notice to the private respondent is dispensed with.

4. Learned Government Advocate (Crl.Side) appearing for the respondent-Police submitted that based on the complaint given by the second respondent/de-facto complainant, the respondent-Police registered a case as against the petitioner for the offence under Section 448 of IPC and Section 4 of Woman Harassment Act and the same was taken on file in C.C.No.87 of 216 on the file of the Judicial Magistrate Court, Arakkonam. In the said case, trial has been commenced and three

witnesses have been examined so far.

5. On a perusal of the records, it is seen that though case in C.C.No.87 of 2016 is pending from 2016, now the petitioner has filed this petition to quash the said CC, after commencement of trial. The petitioner has not approached this Court with clean hands. In order to protract the trial, the petitioner has filed this petition. Further, grounds taken by the petitioner are not the grounds for quashing CC.

6. In view of the above, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed. The petitioner is at liberty to raise all his defence before the Trial Court. 03.07.2025 mfa Index:Yes/No Speaking Order: Yes/No To
