..Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to disburse 6% interest for belated payment of provident fund, Gratuity, and Earned leave Surrender and consequently direct the respondents to disburse the surrendered leave salary, D.A. arrears and last 10 days salary within the stipulated time as may be fixed by this Court.

ORDER

The writ petition has been filed to issue a writ of mandamus to the respondents to pay 6% interest to the petitioner for the belated payment of his terminal benefits namely P.F., Gratuity, Surrender Leave Salary and Earned Leave Salary, D.A. arrears and also the salary for the last 10 days before his retirement, within a time frame to be fixed by this Court.

The case of the petitioner is that he had joined the service of the respondent-Transport Corporation on 04.09.1999, and had retired from service as Driver on attaining the age of superannuation on 31.05.2023. However, the terminal benefits namely provident fund, gratuity and earned leave salary have been settled to the petitioner only on 10.03.2025, and no interest has been paid for the delayed period. In addition, the petitioner was not paid his surrendered leave salary, D.A. arrears and his last 10 days salary of his employment. Therefore, the petitioner had submitted a representation to the respondent dated 27.03.2026, to pay the interest for the belated disbursement of terminal benefits also also his other benefits and entitlements. Since the same was not considered, the present writ petition has been filed.

3. Heard the learned counsel for both sides and perused the materials available on record.

Taking note of the fact that the petitioner had retired from service on 31.05.2023 and his terminal benefits P.F., Gratuity, Surrender Leave Salary and Earned Leave Salary, have been paid to him belatedly on 10.03.2025, and in addition, it is also alleged by the petitioner they he was not paid his surrendered leave salary, D.A.arrears and also the salary for the last 10 days of his employment, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner and also the other entitlements as prayed by the petitioner, with admissible interest, within a period of six weeks from the date of receipt of a copy of this order.
