This case came up for settlement before the Lok Adalat. Both the parties are present. M/s.Ramya V.Rao, learned counsel for the appellant and Mr.E.Rajadurai, learned counsel for the 2nd respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The appellant-G.Munusamy herein filed M.C.O.P.No.39 of 2014 before the trial Court claiming award amount of Rs.20,00,000/- towards compensation with interest and cost.

The Tribunal awarded a sum of Rs.33,750/- along with interest and cost directing the second respondent-The Manager, Bajaj Allianz General Insurance Co.Ltd., herein to pay the said amount to the Apellant. Aggrieved by the above award passed by the Tribunal the appellantG.Munusamy filed an appeal before the Hon'ble High Court.

3. Both the parties having initiated negotiation successfully arrived at a settlement of all the issues arisen in this case as follows: 2/6

The second respondent-The Manager, Bajaj Allianz General Insurance Co.Ltd., has agreed to pay a sum of Rs.1,75,000/- (Rupees One Lakh and Seventy Five Thousand Only) in full quit, in addition to a sum of Rs.33,750/- awarded by the Tribunal and paid by the second respondent to the appellant herein, within a period of four weeks. The appellant also have agreed to receive the said amount of Rs.1,75,000/- (Rupees One Lakh and Seventy Five Thousand Only) in full quit, within four weeks after the award is passed by the National Lok Adalat.

5. Both the parties made a formal request to the National Lok Adalat to pass an award in terms of the above settlement.

As a result award is passed hereby in terms of the above compromise arrived at between the parties directing the second respondent-The Manager, Bajaj Allianz General Insurance Co.Ltd., to pay a sum of Rs.1,75,000/- in full quit, in addition to a sum of Rs.33,750/- awarded by the Tribunal and already paid by the second respondent to the appellant herein, within a period of four weeks from the date of receipt of a copy of order passed by the National Lok Adalat. The appellant is entitled to withdraw the amount of Rs.1,75,000/-the moment the above amount was deposited by the second respondent. 7.Consequently, the appeal stands disposed of. Consequently, connected Miscellaneous Petition if any, shall stand closed. 3/6

8.The Court Fee paid by the appellant to be refunded. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
