Prayer : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to consider and dispose of the representation of the petitioner dated 10.03.2014 seeking appointment to the post of Village servant in Pappireddipatti Taluk, Dharmapuri District.

For Petitioner : Mr.K.M.Ramesh For Respondents : Mr.A.N.Thambidurai Special Government Pleader.

ORDER

(This case has been heard through video conference) This writ petition has been filed for a direction to the 1st respondent to consider and dispose of the representation of the petitioner dated 10.03.2014 for appointment as Village servant in Pappireddipatti Taluk, Dharmapuri District.

2. The case of the petitioner that after completion of SSLC, he registered his name in the employment exchange. The petitioner is a physically disabled person and is possessed of

the requisite qualification, but he was not selected for appointment inspite of his name being sponsored by the employment exchange. However, persons belonging to nearby villages have been selected. The particulars sought for by the petitioner under the RTI Act was rejected. Hence, the petitioner submitted a representation dated 10.03.2014 to the first respondent, on which no order has been passed. Hence, the present writ petition.

Learned counsel appearing for the petitioner submitted that person similarly placed like the petitioner filed writ petition in which the respondents were directed to consider the candidature of the said individual and, therefore, prays that similar order may be passed in the petition as well directing the respondents to consider the petitioner's representation in the light of the orders of this Court within a time frame fixed by this Court.

4. Learned Special Government Pleader appearing for the respondents has no objection to such a direction being issued.

In the light of the fair stand taken by the learned counsel on either side, this Court, without going into the merits of the case, directs the petitioner to submit a copy of the representation dated 10.03.2014 along with the order passed by this Court in the case of similar person, on which order the petitioner relies upon, to the respondents within a period of two weeks from the date of receipt of a copy of this order and on receipt of the said representation, the respondents are directed to consider the same and pass orders on merits and in accordance with law, in the light of the order passed by this Court in respect of similarly placed individuals, as expeditiously as possible.
