2 PADMAVATHI, Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Crl.OP.6213 of 2018 on the file of the High Court, the High Court will be pleased to dispense with the personal appearance of the petitioners before the Trial court in C.C.No.101 of 2016 on the file of Judicial Magistrate, Pappireddipatty, Dharmapuri District, pending disposal of the above CRL.OP.6213/2018.

Order : This petition coming on for orders upon perusing the petition and Memorandum of Grounds in Crl.OP.NO.6213 of 2018 On the file of the High Court and upon hearing the arguments of MR.R.SINGARAVELAN, SENIOR COUNSEL FOR M/S.R.SANKARASUBBU, Advocate for the petitioner AND OF MRS.M.PRABHAVATHI, ADDL. PUBLIC PROSECUTOR for the 1st Respondent, the court made the following order:- Heard Mr.R.Singaravelan, the learned Senior Counsel for petitioners. The learned Senior Counsel for petitioners has submitted that already civil dispute is pending between the petitioners and the second respondent. The counter case also given against the second respondent. He further submitted that since the matter is purely civil in nature and the proceedings against the petitioners before the Trial Court in C.C.No.101 of 2016 on the file of the Judicial Magistrate, Pappireddipatty, Dharmapuri District has to be quashed.

2. The learned Additional Public Prosecutor has submitted that non-bailable warrant pending against the first petitioner and hence, https://hcservices.ecourts.gov.in/hcservices/

she opposed to grant any interim order.

3. Considering the aforesaid submissions, the personal appearance of the petitioners 2 and 3 before the Trial Court is dispensed with.
