Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the 2nd respondent to transfer patta in favour of petitioner in respect of lands measuring an extent of 2.62 acres in Survey No.517 and 2.42 acres in Survey No.518/1B situate at Hosur village and Taluk, Krishnagiri District without insisting No Objection Certificate from Tamil Nadu Housing Board within the time to be stipulated by this Court based on the petitioner's representation dated 01.02.2016.

ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner and his brothers and sisters, claim to be the joint owners of the lands admeasuring to an extent of 2.62 acres in Survey No.517 and 2.42 acres in Survey No.518/1B situate at Hosur village and Taluk, Krishnagiri District and he

prayed for issuance of patta in respect of the said survey numbers and the 2nd respondent, vide communication in Na.Ka.No.314/14/A dated 30.05.2016, has requested the Tamil Nadu Housing Board/1st respondent to furnish the details in respect of the issuance of No Objection Certificate for grant of patta and since no response is forthcoming, the petitioner came forward to file the present writ petition.

Heard the learned counsel for the petitioner ; Mr.R.Govindasamy, learned Special Government Pleader who accepts notice on behalf of the respondents 1 and 2 and Mr.V.Anandamoorthy, learned counsel who accepts notice on behalf of the 3rd respondent.

Though the petitioner has prayed for a larger relief, this Court, in the light of the facts and circumstances and without going into the merits of the same, directs the respondents 1 and 3 to respond to the communication of the 2nd respondent dated 30.05.2016 in Na.Ka.No.314/14/A with a further communication to the petitioner and the 2nd respondent, on receipt of the communication, shall proceed in accordance with law and give a disposal with regard to the application submitted by the petitioner for grant of patta as expeditiously as possible and not later than eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the private respondents herein. The writ petition is disposed of with the above direction. No costs.
