O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 457 and 380 of IPC in Crime No.304 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that during the COVID lockdown, the TASMAC shop was broke up and liquor worth of Rs.53,760/- was stolen. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is no way connected with the crime and not involved or associated with the other accused. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that during the course of investigation, the respondent police has zero down five accused. Out of five accused, three of them were arrested. The petitioner is one of the absconding accused. He would further submit that the investigation reveals that the petitioner accompanied with other accused when the theft was committed and unless they are apprehended and taken into custody for interrogation, the complete recovery of the stolen goods cannot be done.

5. Considering the above submissions of the learned Additional Public prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner.
