Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents herein to settle 6% interest for the belated settlement of commutation of pension amount to the petitioners 1, 2 and 4 herein, 10days salary to the petitioners 1 to 4 herein with 6% interest and earned leave salary for 15 days with 6% interest to the third petitioner herein from the date of eligibility to date of payment as per the table enclosed in the writ 1/4
petition, by considering the representations of the petitioners dated 05.04.2024.

The petitioners have filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to settle 6% interest for the belated settlement of commutation of pension amount to the petitioners 1, 2 and 4, 10 days salary to the petitioners 1 to 4 with 6% interest and earned leave salary for 15 days with 6% interest to the third petitioner from the date of eligibility to date of payment, by considering the representations of the petitioners dated 05.04.2024. 2.The learned counsel appearing for the petitioners would submit that the petitioners have given representation claiming 6% interest for the belated settlement of commutation of pension amount to the petitioners 1, 2 and 4, 10 days salary to the petitioners 1 to 4 with 6% interest and earned leave salary for 15 days with 6% interest to the third petitioner from the date of eligibility to date of payment and such representation is still pending before the respondents. 2/4
3.At this juncture, the learned Standing Counsel would fairly submit that in view of the order passed in similar writ petition, the petitioners would be eligible for 6% interest upon belated eligible payment. In respect of last 10 days salary and earned leave salary, the learned Standing Counsel would submit that the respondents would reconcile with the service register of the petitioners and if there is any due, they would make the payment.
4.In such view of the matter, this Court directs the respondents to pay 6% interest upon belated eligible payment, within a period of six weeks from the date of receipt of a copy of this order. In respect of last 10 days salary and earned leave salary, the respondents are directed to verify the service register of the petitioners. If the petitioners are entitled for the same, the respondents are directed to settle the said amount along with the above payment. The writ petition is dismissed. No costs.
