ORDER
(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379, 430 of IPC r/w 21(5) 3 of Mines and Minerals (Development & Regulation) Act, 1957 and T.N. Public Property (Prevention of Damage & Loss) Act 1992, in Crime No.1990 of 2020, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the Inspector of Police was informed that when the Ashok Leyland Vehicle bearing Registration No.TN 21 AC 0997 was intercepted, the lorry driver abandoned the goods inside the vehicle and ran away. On the inspection of the vehicle, they found that 1/4 unit of river sand in https://hcservices.ecourts.gov.in/hcservices/
the vehicle. Later investigation has revealed that a person who pleaded is Yuvraj who is the petitioner herein. Since the offence of illicit exploitation of the river sand is rampant, this Court has held that the larger interest of the public is more important than the individual liberty of a person, who are exploiting the natural resources illegally. Following the dictum of this Court rendered in the case of "Bala @ Balasubramani -vs- State represented by the Inspector of Police, Thakkolam Police Station, Vellore District" dated 03.09.2020 in Crl.O.P.No.13334 of 2020 etc. batch, this petition for Anticipatory Bail is dismissed.
