O R D E R

This Civil Revision Petition is directed against the order dated 07.12.2015 in I.A.No.122 of 2015 in I.A.No.250 of 2014 in

O.S.No.93 of 2014, whereby and whereunder, the learned Subordinate Judge, Gobichettipalayam, passed an order to amend the property shown in the Schedule in I.A.No.250 of 2014.

2. During the currency of this Civil Revision Petition, the parties have settled the matter, in and by which, the petitioners agreed to pay a sum of Rs.1,50,000/- to the respondent in full quit.

3. The learned counsel for the petitioners handed over a cheque for a sum of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand Only) bearing No.249354, drawn on Dena Bank, Gobichettipalayam Branch, dated 07.02.2017. According to the learned counsel for the petitioners, the cheque would be honoured by the petitioners.

4. In view of the settlement arrived at among the parties, the learned Subordinate Judge, Gobichettipalayam is directed to adjourn the suit in O.S.No.93 of 2014 and post it on 20.02.2017. In case, the petitioners failed to honour the commitment made in the joint memo dated 14.11.2016, the order passed by the learned Trial Judge attaching the property would remain and further action would be taken to continue the suit in O.S.No.93 of 2014.

5. The joint memo dated 14.11.2016 is taken on record.

6. The Civil Revision Petition is disposed of with the above direction. No costs. Consequently, connected civil miscellaneous petition is closed.
