ORDER

This criminal original petition has been filed seeking a direction to the 1st respondent to register the complaint of the petitioner dated 16.08.2016 and investigate the same under the supervision of the 2nd respondent.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor submits that on a complaint given by the petitioner, petition enquiry in CSR No.381 of 2016 and on https://hcservices.ecourts.gov.in/hcservices/

the complaint given by the opposite party against the petitioner, petition enquiry in CSR No.350 of 2016 is pending before the first respondent and that, the petitioner is not cooperating with the enquiry.

4. Hence, the petitioner is directed to co-operate with the enquiry and the first respondent Police is directed to conduct enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.

With the above direction, this criminal original petition is closed.
