DATED: 07.04.2022

CORAM

THE HONOURABLE DR. JUSTICE ANITA SUMANTH W.P.No.20717 of 2014 and M.P.No.1 of 2014 1.V.Kothandaraman 2.V.Madhan ... Petitioners Vs 1.The Member Secretary, No.1. Gandhi Irwin Road, Egmore, Chennai 600 008.

2.The Chief Executive Officer, Koyambedu Market Executive Committee, Koyambedu Wholesale Market Complex, Chennai 600 092.

3.N.Radhakrishnan 4.Mrs.P.Navaneetham ... Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, call for entire records pertaining to impugned order dated 23.07.2014 passed by 2nd respondent herein and quash the same and direct the respondents 1 and 2 to release the sealed shop and provide the license in the name of the petitioners in their own cost until vacate the premises without insisting from the 4th respondent for the year 2014-2015 and for subsequent period. For Petitioners : No Appearance For Respondents : No Appearance

O R D E R

There is no appearance for the petitioners. Neither is there any appearance for respondents, though the names of the counsels and description are duly printed in the cause list.

2. The prayer of the petitioners, who claim to have been doing business of selling of vegetables wholesale and retail in Koyambedu Market, is for a certiorarified mandamus, quashing order dated 23.07.2014 and consequential direction to respondents 1 and 2 to reopen sealed shop and provide licenses in their names.

3. There is no merit in this writ petition, and I suspect that nothing survives therein. There has been no interim protection granted to the petitioners, pending writ petition that would have kept the cause of action alive.

4. It is inconceivable that shop, bearing No.82, 'E' Block, Koyambedu Market, Chennai- 600 092, sealed as early as on 23.07.2014 would remain under seal till date, as the process of allotment of shops by the concerned vending Committee would have long concluded.

5. Accordingly, this Writ Petition stands dismissed as nothing survives therein for adjudication. No costs. Connected miscellaneous petition is closed.
