ORDER

This writ petition has been filed to direct the second respondent to settle gratuity benefits to the petitioner for the service rendered from 01.11.1997 to 05.06.2013. 2.According to the learned counsel for the petitioner, the petitioner was working as a Gardener in the second respondent College with effect from 01.11.1997. While so, without any intimation, he was terminated from service on 05.06.2013. His repeated attempts to join duty ended in vain. Hence, he sent a representation dated 02.09.2013 to the second respondent claiming gratuity benefits for the service rendered from 01.11.1997 to 05.06.2013. Finding no response on the same, he has come up with this writ petition for the aforesaid relief. https://hcservices.ecourts.gov.in/hcservices/

3.On the other hand, the learned counsel appearing for the second respondent submitted that the petitioner's service was not regularised and hence, he is not entitled for any relief. However, he fairly submitted that the second respondent would consider the petitioner's representation and pass appropriate orders on merits, within a time frame to be stipulated by this Court.

4.Considering the facts and circumstances of the case and having regard to the submissions now made by the learned counsel on either side, this Court, without going into the merits of the case, directs the second respondent to dispose of the representation dated 02.09.2013 submitted by the petitioner, if not already disposed of, on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

5.Accordingly, the writ petition stands disposed of. No costs.
