PRAYER: This Criminal Original Petition filed under Section 438 of Cr.P.C., seeking to enlarge the petitioner on bail in the event of his arrest pending investigation in Crime No.727 of 2020 on the file of the Sub-Inspector of Police, Aladi Police Station, Cuddalore District.

ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 430 & 379 of IPC read with 21 (1) of Mines and Minerals (DR) Act in Crime No.727 of 2020 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner has transported one unit of sand through tractor tipper lorry. On seeing the Sub-Inspector of Police, the petitioner has abandoned the vehicle with the goods and ran away. The tractor with tipper bearing Registration No.TN 91 X 7873 in the name of Swaraj 744 FE has been seized by the police.

3. The learned Counsel for the petitioner has now come out with the scope of seeking Anticipatory Bail.

4.Now on considering the gravity of the crime and the dictum laid down by this Court rendered in the case of "Bala @ Balasubramani -vs- State represented by the Inspector of Police, Thakkolam Police Station, Vellore District" dated 03.09.2020 in Crl.O.P.No.13334 of 2020 etc. batch, this petition for Anticipatory Bail is dismissed.
