ORDER
The petitioners who apprehend arrest for the alleged offences under Sections 120B, 409, 420, 468, 471 IPC and 13(2) r/w 13(1)(a) of Prevention of Corruption Act, in Crime No.RC 0322024A0006 of 2024 on the file of the respondent Police or on their appearance before any Court in connection with the case in CC.No.3 of 2025 on the file II Additional District Judge (CBI Cases), Coimbatore seeks anticipatory bail.
2. The case of the prosecution is that the accused persons sanctioned several loans to the borrowers by violating the Bank norms and created loss to the tune of Rs.25.69 Crores to the State Bank of India, Sathyamangalam Branch.
3. The learned counsel for the petitioners submitted that the first petitioner who was working as Probationary Officer of the State Bank of India, Sasthyamangalam Branch sanctioned loans to the borrowers, based on the relevant documents and there were no irregularities as alleged in the F.I.R. The
second petitioner is no way connected with the alleged offences and a false case has been foisted as against the petitioners. Hence, they seek anticipatory bail.
4. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that investigation has been completed and charge sheet has also been filed and on receipt of summons, the petitioners appeared before the trial Court.
5. I have given my anxious consideration to either side submissions.

Considering the facts and circumstances and also considering the fact that the learned Government Advocate (Crl.Side) appearing for the respondent has no serious objection in granting anticipatory bail to the petitioners, and also considering the nature of the allegations, this Court is of the firm view that, custodial interrogation of the petitioners is not required. Hence, this Court is inclined to enlarge the petitioners on anticipatory bail, subject to certain conditions.
7. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from
the date on which the order copy is made ready, before the II Additional District Judge (CBI Cases) Coimbatore on condition that the petitioners shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a)If the petitioners fail to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled;
(b) The sureties shall affix their photographs and left thumb impression in the application for surety slip (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identity proofs to ensure their identity;
(c) The petitioners shall report before the concerned trial Court on all the hearing dates without fail; (d) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the
conditions have been imposed and the petitioners are released on anticipatory bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];
(e) If the petitioners thereafter abscond, a fresh FIR can be registered under Section 269 of the BNS Act.
