The petitioners, who apprehend arrest at the hands of the respondent Police for the offences punishable under Section 4(1)(A) of the Tamil Nadu Prohibition Act, in Crime No.94 of 2026 on the file of the respondent police, seek anticipatory bail.

The case of the prosecution is that the accused were found to be in illegal possession of more than one hundred liquor bottles, each containing 180 ml of XXX Rum Carnival, without a valid license. Hence the case.

Learned counsel appearing for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case since they have previous cases. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioners.

Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for the grant of anticipatory bail to the petitioners. He further submitted that 13 previous cases are pending against the first petitioner and in respect of the second petitioner, 9 previous cases are pending. 5.

Considering the above facts and circumstances of the case, taking note of the nature of allegation and also considering the antecedents of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
