Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order dated 07.02.2018 in proceedings namely Na.Ka.No1/3134/2018 issued by the 2nd respondent herein and to quash the same and consequently direct the respondents to grant compassionate appointment to me based on my representation dated 30.01.2018 for a suitable post for the death of my father late K.Thiruvengadam forthwith.

ORDER

This writ petition is filed challenging the impugned order dated 07.02.2018 and consequently direct the respondents to grant compassionate appointment to the petitioner.

2. On a perusal of the papers filed by the petitioner along with this writ petition, it clearly states that the petitioner's father died on 10.02.1991, at which time the petitioner was only 9 years old.

3. In that view of the matter, whether the petitioner can apply for compassionate appointment after attaining the age of majority or within a period of three years from the date of death of his father has already been referred to the Full Bench and has been answered against the petitioner in the case of Nandini Dev and Ors. Vs. The Secretary to Government, Health and Family Welfare Department and Ors. [W.P.(MD).Nos.7016 of 2011 & etc., batch].

4. In view of the said authoritative pronouncement of the Full Bench, this Court cannot come to rescue of the petitioner. In view thereof, 2/4

this writ petition is filed without any merits and accordingly, it is dismissed. No costs.
