ORDER

The petitioner apprehends arrest for the alleged offences under Sections 23(4) of TNSC (RDCS) Order 1982 r/w 7(1)(a)(ii) of EC Act, in Crime No.23 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that, during a vehicle check, he was found involved in the illegal transportation of 4000 kilograms of PDS rice. Hence, a case has been registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has three previous cases of similar in nature. He further submitted that, in the present case also, the petitioner was found to have illegally transported 4,000 kgs of PDS rice. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. Considering the serious nature of the allegations against the petitioner and the fact that the petitioner has bad antecedents, this Court is of the firm view that the petitioner does not deserve anticipatory bail. Hence, this Criminal Original Petition is dismissed.
