ORDER

This Criminal Original Petition has been filed by the petitioner to direct the first respondent to consider the representation dated 21.04.2025 and direct the second respondent not to harass the petitioner without due process of law.

2. When the matter came up before this Court on 09.06.2025, it was submitted by the learned Government Advocate (Crl. Side) that the petitioner is absconding. Hence, in order to ascertain the actual facts, this Court had directed the petitioner to appear before this Court on 11.06.2025. On 11.06.2025, at the request of the learned counsel for the petitioner, the case was posted on 13.06.2025.

3. Today (13.06.2025), when the matter is taken up for hearing, the petitioner appeared before this Court and this Court also enquired the petitioner as well as heard the learned Government Advocate (Crl. Side) appearing for the respondents.

4. It is stated by the learned Government Advocate (Crl. Side) that based 2/5

on the confession given by A1, the petitioner has been impleaded in Crime No.311 of 2024 on the file of the second respondent police for the offence under Sections 296(b), 132, 351(2) of BNS and Sections 8(c) and 20(b)(ii)(A) of NDPS Act. In yet another case also the petitioner has been impleaded based on the confession of co-accused. However, there is no recovery from the petitioner.

5. Considering the above facts and circumstances, the respondent police is directed not to harass the petitioner.
