ORDER

The present petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents not to convert the single phase power cable line into three phase power line and to carry on the work of providing new three phase power connection through alternate route.

The case of the petitioner is that the petitioner is residing at Bajanai Koil Cross Street, Thiruvallur Taluk & District, which street is narrow and eight feet wide, wherein a single phase electricity service connection is available, adjacent to which street, there are agricultural lands in which farming is being carried out by the people in the locality including the petitioner herein.

On the application made by one Subramaniam for three phase electricity service connection, the Electricity Board Authorities are arranging to convert the existing single phase power line which is running through the said street, into a three phase power line, for which four new poles have been installed in the farm lands including the petitioner's land due to which the residents of that street including the petitioner will be put to increased risk of electrocution. Instead, the new power connection can be obtained from other poles which is already having three phase power connection by erecting a single additional post pole and the said procedure may be cost efficient. With regard to the same, the petitioner made a detailed representation dated 15.10.2021 to the respondents. However, the same has not been considered till date.

Despite the same, the process of power conversion is being carried out by the authorities. Having left with no other alternative, the petitioner has come up with the present petition.

Though very many grounds have been raised, the learned counsel for the petitioner submits that it would suffice if this Court issues direction to the respondents to grant relief to the petitioner in view of the petitioner's representation dated 15.10.2021, within the time frame fixed by this Court.

4. On the above contentions, heard the learned standing counsel appearing for the respondents.

5. Upon hearing the learned counsel on the either side, this Court without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 15.10.2021 and take appropriate action on the same in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

6. This petition is disposed of accordingly with the aforesaid direction. No costs. Consequently, the connected Miscellaneous Petition is closed.
