The petitioners, who were arrested and remanded to judicial custody on 27.05.2024 in connection with Crime No.251 of 2024 registered for the alleged offences punishable under Section 284 and 328 of IPC and Section 24(1) of Cigarettes and other Tobacco Products Act, 2003, seek bail.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are in custody from 27.04.2024 and they are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioners.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioners stating that the petitioners were found to be in illegal possession of 633 kilograms of banned tobacco products. He also submitted that the petitioner is the person who had brought the banned tobacco products from Rajasthan for sale. He also submitted that there is no previous case against the petitioner, however, the investigation in this case is not yet completed.

4. Heard the learned counsel for the petitioners and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.

5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and also considering the fact that the investigation is not yet completed and also the quantity of product involved in the offence, this Court is not inclined to grant bail to the petitionesr.
