By consent, this writ petition is taken up for disposal at the admission stage itself.
2. The writ petition has been filed for issuance of writ of mandamus directing the respondents to consider the claims of the petitioner and regularise the petitioner's service in the post of Lecturer with all consequential benefits as was given to similarly placed persons namely J.Rajendran and M.Jayasankar.
3. The case of the petitioner is that as per the directions issued by this court in WP Nos.16533 & 16534 of 2012, the first respondent has framed adhoc rules in G.O.(Ms) No.264, Tourism, Culture and Religious Endowments (C1-1) Department dated 24.10.2013. Subsequently, the third respondent has forwarded a letter dated 27.02.2014 to the second respondent seeking some amendments to the adhoc rules who in turn had forwarded the proposal to the first respondent vide letter in Na.Ka.No.4132/A3/2015 dated 02.11.2015. However, the first respondent has not made any amendment so far. Hence, this writ petition.
4. Heard Mr.G.Elanchezhiyan, learned counsel appearing for the petitioner and Mr.S.Gunasekaran, learned Government Advocate appearing for the respondents.
5. The learned counsel for the petitioner submitted that it would suffice if a direction is issued to the first respondent to consider the proposal made by the second respondent.
6. Considering the submission made by the learned counsel for the petitioner, this court directs the first respondent to consider the proposal forwarded by the second respondent vide letter dated 02.11.2015 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
With the above direction, the writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
