ORDER

This Writ Petition has been filed for the issuance of a writ of mandamus directing the respondent to award 1 mark for the wrong question No.36 and 120 in booklet "D" series to the petitioner (Reg.No.0150692) and permit the petitioner to undergo all further recruitment process including Viva Voce test in the above selection vide Notification No.2 / 2019 dated 08.03.2019 within the time frame fixed by this Court.

2. The one and only contention of the petitioner is that the petitioner has not been given any marks for two questions (i.e. Q.Nos.36 & 120) for which he has given right answer.

3. However, in the counter affidavit it appears that the petitioner has been given with marks for Q.Nos.36 & 120. The petitioner has ticked option 'A'; despite option 'B' is the right answer. The expert committee had chosen to give marks for those persons who opted the options 'C' and 'D' as well. Hence the petitioner claims that he is also entitled to get half mark. Because the expert committee has considered two other wrong answers

apart from 'B' and so similar treatment should be given to option 'A' as well.

4. The learned Additional Advocate General submitted that the selection process itself is over and the petitioner cannot be subjected to the selection process for the year-2019.

5. Though the petitioner's justification is not wrong, much water has flown under the bridge now. For the selection process of the year 2019, the petitioner cannot be now subjected for the recruitment process. The petitioner should have approached the Court much earlier for the prayer sought by him. However, it is up to the petitioner to try his luck during the next selection process.

6. In view of the reasons stated above, this Writ Petition is dismissed as infructuous. No costs. Connected miscellaneous petitions are closed. 18.10.2023 bkn
