This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus directing the respondents to pay difference in leave salary and difference in gratuity with 10 percentage interest as per 14th wage settlement dated 24.08.2022 to the petitioner. For Petitioner(s):

wage settlement dated 24.08.2022 to the petitioner."

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner joined the service of the respondent corporation as Helper Trainee on 09.04.1986 and retired on 30.04.2020 as a Sr.T.M. Subsequently, the 14th Wage Settlement was entered into between the Management and the Trade Unions on 24.08.2022, pursuant to which the wages and pension were also revised with effect from 01.09.2019. Since the petitioner had retired on 30.04.2020, he is entitled to the difference in leave salary and gratuity as per the 14th Wage Settlement. Accordingly, the petitioner made a representation seeking difference in gratuity, difference in leave salary with interest. However, the said representation has not been considered so far.

4. In view of the above, the respondents are directed to pay eligible difference in gratuity and difference in leave salary as per the 14th Wage settlement dated 24.08.2022, together with 6 percentage interest to the petitioner, within a period of twelve weeks from the date of receipt of a

copy of this order.

5.With the above direction, this Writ Petition stands disposed of. No costs.
