The present Writ Petition is filed seeking to issue a Writ of Mandamus, directing the 1st respondent to consider the claim of the petitioner for promotion as Head Master in the Forest Higher Secondary School, Pudurnad, Tirupatthur Taluk & District in the light of his representation dated 29.04.2019.
2.By consent of the learned counsel appearing for the petitioner, the learned Government Advocate (Forest) appearing for the respondents 1 to 3 and learned Government Advocate appearing for the 4th respondent, the Writ Petition is taken up for disposal at the admission stage itself.
3.According to the petitioner, he is working as a Physical Director, Grade I, equivalent to the post of P.G. Assistant. He is fully qualified to be promoted as Head Master of Forest Higher Secondary School, Pudurnad. The post of Head Master in Forest Higher Secondary School, Pudurnad became vacant on the retirement of incumbent on attaining the age of superannuation. The petitioner is given additional charge as Head Master of the said School, instead of appointing as Head Master. He has given representation to the 1st respondent on 29.04.2019, requesting the 1st respondent to appoint him as Head Master of the Forest Higher Secondary School and has come out with the present Writ Petition to consider his representation.
4.In view of the limited relief sought for by the petitioner and without going into the merits of the case, the 1st respondent is directed to consider the petitioner's representation dated 29.04.2019 and pass orders, on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
5.With the above direction, this Writ Petition is disposed of. No costs.
