ORDER
This writ petition has been filed challenging the G.O.(Ms)No.3 of 2025 dated 22.01.2025 issued by the first respondent, quashing the same and consequently restrain the respondent Nos.2 and 3 from allotting or alienating in any manner whatsoever any area earmarked for common purpose in the Dr.Vikram Sarabhai Industrial Estate, Thiruvanmiyur.

It is the case of the petitioner that the petitioner association consists of all the manufacturers who are also unit holders/owners of plots in the Vikram Sarabhai Instronics Estate located in Thiruvanmiyur, Chennai. The Industrial Estate was formed pursuant to G.O.Ms.No.1131 (Industries-Spl) dated 28.04.1971 (for Phase I) and G.O.Ms.No.1045 dated 27.07.1981 (for Phase II), both of which established a unique scheme of allotment whereby the allottees paid, on a pro-rata basis, the cost of the land comprises in their respective units as well as the costs attributable to the common amenities and facilities such as internal roads, storm water drains, sewerage systems, administrative building, creche and over head tank. While so, vide G.O.Ms.No.21 dated 20.07.2018, the Industrial Estate was transferred to the second respondent and the second respondent sought to convert the common areas into saleable sheds which advertisement was challenged before this Court in WP.Nos.5352 & 5346 of 2021 and this Court vide order dated 11.07.2024 set aside the advertisement and
held that the land earmarked for common purpose cannot be alienated. The writ appeal filed in W.A.Nos.2409 & 2410 of 2025 are pending without interim orders. Now, the Micro, Small and Medium Enterprises (C) Department decided to transfer of land in the 8 Electrical and Electronic Industrial Estates and one Ceramic Industrial Estate and issued a Government Order in G.O.Ms.No.3 of 2025 dated 22.01.2025 purporting to amend the earlier Government Order in G.O.Ms.No.21 with wider expression "for allotment as well as maintenance of common infrastructure". Challenging the said Government Order, the present writ petition has been filed.

The learned counsel for the petitioner submitted that the petitioner has no objection in the respondents maintenance of common area, however, it is the grievance of the petitioner that the respondent has no power to alienate common area which is meant for common area alone. Hence, seeks for appropriate order.
4. The learned Government counsel as well as the learned Standing Counsel submitted that the respondents have no intention to alienate the common area and they have no power to alienate the common area.
5. Recording the submissions of the learned Government counsel as well as the learned Standing Counsel, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions stand closed.
