Respondents Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondents 1 and 2 to provide the petitioner forthwith suitable light work/office work/desk work with continuity of service, pay protection, wages and other consequential benefits with effect from 09.02.2011 within a specified time fixed by this Court. ORDER

The prayer made in this writ petition is to direct the respondents 1 and 2 to provide the petitioner suitable light work/office work/desk work with continuity of service, pay protection, wages and other consequential benefits with effect from 09.02.2011 within a specified time to be fixed by this Court.

2.Today, when the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that the petitioner is no more and hence, the writ petition may be closed, with liberty to the legal heirs of the petitioner to approach the authority concerned with a fresh representation for appropriate relief.

3.There is no objection on the side of the respondents for granting such relief to the legal heirs of the petitioner. 4.Considering the facts and circumstances of the case and having regard to the submissions now made by the learned counsel on either side, this Court permits the legal heirs of the petitioner to submit a fresh representation for appropriate relief along with a copy of this order to the authority concerned within a period of three weeks from the date of receipt of a copy of this order. On such submission, the authority concerned shall consider the said representation and pass appropriate orders on merits and in accordance with law, within a period of four weeks thereafter.

5.Accordingly, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petitions are also closed.
